targetted there exists throughout the united states scores of civil rights organizations concerned with providing legal resources to minori ties and the poor though under-funded and over burdened in terms of caseloads they represent the avenue of last appeal for victims of discrimina tion political and legal disenfranchisement gov ernment misconduct con stitutional violations and the host of structural and institutional violations and the host of structural and institutional inequities that represent the gap between the real.sy of injustice and the ideal of true equality and justice in american life these organizations work as privately support ed attorneys general in cases which the federal government is regrettably derelict in prosecuting itself hrough the civil rights division of the u s department of justice advent of the consortium the publisher of the impartial citizen has suc _ cessfully enlisted a con sortium of four such organizations in address ing the issue of harass ment of black elected and appointed officials in the prototype case of barbara sims vs lawrence cook chief judge new york state court of appeals the impartial citizen and its publisher persisted in focusing public atten tion on this cancer in our society in the hill know ledge that it was not a popular cause even within the civil rights move ment and its legal instruc tions who work from day to day on the crisis edge of a holding action to save lives on death row open class room doors halt illegal electoral practices or illegal surveillance activi ties of the government it was mr prichard's conviction however that black elected and appoint ed officials had been targetted for extinction in a sinister new agenda of lawlessness under color of law because of the extra ordinary strides made by blacks in the sixties in gaining political influence in their communities and in the halls of government paying tribute the i.npartial citizen pays tribute to members of the legal consortium the center fo constitu tional rights founded by william kunstler arthur kinoy the late ben smith and morton stavis in 1966 and its staff attorney betty bailey to the naacp its national executive director benja min hooks and associate general counsel george hairston the national conference of black law yers hey ward bums and the national bar associa special to the buffalo criterion from the impartial citizen lion for courageously ac cepting the challenge d restoring buffalo cot court judge barbara sims to her rightful place on the bench to which she was duly elected in 1979 the significance of this legal initiative is twofold it attests to the sensitivity responsiveness and fore sight of these public interest organizations to outrageous miscarriages of justice where the victims are black elected and appointed officials and civic leaders who have become victims of official and private harrassment it reflects at the same time an important political commitment to the sup port of black leadership in public and civic life which has become increasingly under siege since the civil p.stf.'.-.'e era in this sense the consortium symbolically represents an unprece dented multi-ethnic array of forces committed to transcending the class conflicts which partially impeded the progress of the civil rights movement after the assassination of rev martin luther king jr the publisher of the imparliil citizen takes pride in having contribu ted to the formation of this consortium judge barbara m sims was removed from her elected post on march 29 1984 by the new york state court of appeals for havine admitted to bail 3 defendants in 1978 who hired her husband wil liam sims an attorney after they were released she also admitted to bail 7 defendants in 1979 the first year after her election who later hired attorney sims to represent them judge sims testified that she did not ask the defendants to hire her husband and in no manner participated in their de cision to retain him one of the defendants stated under oath that a repre sentative of the commis sion on judicial conduct questioned him regarding the circumstances in 1980 at which time he told the investogator that he did not know judge sirrs had never seen nor talked to her the remaining defendants stated that at no time did the investiga tor from the commission ever question them the commission by gerald stem in 1981 in an unsworn document charged judge sims with releasing her husband's clients on bail even though they knew that their allegations were false no one appeared at any of the hearings to testify against
