Islanders To Vote On Gambling Law ISLANDERS will not only decide who is to serve as supervisor for 1990-91 and elect two councilmen, a peace justice and highway superintendent to four year terms, they will also ballot on a referendum concerning the games of chance law. "Shall it be lawful for any authorized organization, upon obtaining a license therefor, to conduct games of chance within the town of Grand Island...authorized and subject to provisions of Local Law #5 as adopted by the board of the town of Grand Island," the ballot states. "Authorized organizations" are defined in Paragraph 4 of Section 186 of the Municipal code as bonafide religious or charitable groups, educational, fraternal or service groups, veterans groups and volunteer firemen who have a not-for-profit status. "Games of Chance" are defined as merchandise wheels and other games authorized by the NYS Racing and Wagering Board including craps, roulette, black jack, big six, money wheel, chuck-a-luck, hazard, under and over 7, beat the dealer, big nine, color wheel, bang, joker seven, horse race wheel, best poker hand and bell jar. This law differs from open gambling in that it is designed only for not-for-profit groups to fund raise and limits the frequency (once a month), the odds and amount of money bet (maximum of $2 on any one game) and prizes awarded. All equipment must be purchased or leased from an authorized state dealer. The law further states, "Authorized organizations, may upon obtaining a license from the town clerk, conduct games of chance within the Town of Grand Island as provided in Article 9-A of the General Municipal code and as provided further in this local law. Such games of chance shall be conducted in accordance with the laws of the State of New York and with the rules and regulations adopted by the New York State Racing and Wagering Board and pursuant to this local law. "The conduct of games of chance shall be subject to the restrictions imposed by Section 189 of the General Municipal Law as amended; however, games of chance shall not be conducted on Easter Sunday, Christmas or New Year's Eve. "The Supervisor of the Town of Grand Island shall exercise control over and supervision of all games of chance conducted under a duly authorized license...."
