NY i~!Kl 77.1 7»i7il 50c 28 PAGES VOL. 47 NO. 52 • Mar. 22, 1991 Town Board Clamps Down On Golf Course Plan THE TOWN board by resolution Monday took first steps in an effort to prevent Niagara Associates Group from converting the River Oaks Golf Course into a private enterprise. Approved in a 5-0 vote was a resolution which stated, in part, that "the town does herewith declare that the use and occupancy (of the course) permitted as the result of the original planned unit development approval as amended shall be revoked within 30 days unless said proposed privatization process is suspended by the present owners." It also noted if the revocation "under this resolution" is required, the town would notify the owners, state and county officials "including but not limited to the New York State Liquor Authority and the Erie County Planning Authority." The resolution also called attention to zoning rules, requirements and regulations "set forth as a condition of the establishment of the Planned Unit Development." which, it further stated, "required reservations of rights of public use in the golf course together with public recreational use and open space requirements in areas adjacent to the golf course." The board in a second resolution took issue with what it called "substantial misleading deception factual basis" submitted by the developers for the State Environmental Quality Review and town ordinance process." The resolution went on to state that the town was suspending the "continuation of applications" concerning the Town to Petition PSC For Pipeline Rehearing THE GRAND Island Town Board has agreed to petition the Public Service Commission for a rehearing on the gas pipeline which Empire State Pipeline Co. proposes to construct across the Island. Although PSC January 3 approved Empire's proposal for the line from Canada to Syracuse, crossing Grand Island enroute, final decision still rests with the Federal Energy Regulatory Commission.The rehearing requested by the board Monday will allow Grand Island to again present reasons why the town should be excluded from the route. The motion for a rehearing must be brought up within 30 days after the Commission has issued a formal order and opinion, Attorney David J. Seeger informed the town. The board action Monday included employing Seeger for $3800 to represent the Island in the proceedings. The motion to continue fighting the issue was presented by Councilman James H. Pax.
