Photo by BarM Lare ■ Marina Wins Topsoil Battle: Town May Appeal OWNERS of River Oaks Marina were victors in the three week jury trial that ended last Friday before U.S. District Judge William M. Skrctny. Grand Island was the loser. Voided was the 1986 town moratorium, banning the removal of clay from the Island, and awarded to the Marina developers was $821,000 although they had originally asked for $4.4 million in damages. River Oaks Marina is now free to sell out of town the clay, stockpiled after being dug when the canal was built into the boat docking site on Fast River Road. Marina operator James H. Chase expressed disappointment over the dollar amount of the verdict, but elation that the soil, stored across the road, could now be sold off the Island. "The town board believes the jury verdict was unjustified and certainly excessive," Supervisor James H. Pax said at the conclusion of the trial, "after what we felt was an excellent defense on behalf of the town." "Our attorney will be making post trial motions to that effect," Pax said, adding "If the verdict remains intact, we will consider an appeal to a higher court." Pax also said "We will be consulting with our attorney about Lhe options available to the town and we will make every effort to protect the interests of the town with remedies available to us." MEK (More information regarding this issue is the topic of a page 2 editorial) Grand Island Band Concerts Begin Tuesday GRAND ISLAND'S '92 Summer Band Concert line up includes old favorites previously appearing in years past. Starting off the Summer Tuesday Concert Series at Town Hall is 23 SkiDoo with its popular Dixieland sound. The concert will begin at 7 P.M. and there will be no rain date. Islanders are urged to bring a lawn chair or blanket and enjoy the music offered by the Town's Parks and Recreation Dept. Other concerts scheduled for the summer are Fiddlesticks (bluegrass) July 7, Buffalo Banjo Band July 14, Nickel City Clippers (Dixieland) July 21, Buffalo Zew Revue (fiddles) July 28, The Tin Roof Jazz Band August 4, Sikora Post American Legion Band August 11. All concerts are at 7 P.M. Rain dates arc the following Thursday. WEATHER: The Old Farmer's Almanac says -June 27-28: sunny & warm. June 29-30: heavy showers, milder. July 1-3: showers.
