affairs the following appear among tha corres pondence from minister sickles to minister fish october 16 1863 i i have the honor to transmit herewith a copy of my note addressed to the minister of state silvela on the 28th ult.,|and a copy and translation of hia reply dated the sth inst sickles to si i vela septemper 2s isl.c the undersigned had the honor i a july last to offer to spain good the ofecesof the united states in a manner that should ba found most expedient for the peacificationof cnba tbe minister of state in a subsequent conference communicate to the undersigned a reply of the cabinet of madrid to th over ture and the undersigned having duly transmitted the same to his goverment in forniod the minister of state on the 3d uf september of the views of the presi dent in regard to the basis suggested on tbe part of spain in that conference and at the same time communicated to tbe cabinet of madrid the basis proposed by the united states for an adjustment of the questions pending between spain and cnba the propositions were deemed by the pres dent to be most advantageous to all inter ests compromised by the deplorable conflict in cuba and t it was believed that this arrangement would be acceptable to spain the minister of state acknowledging tbe sincerity and friendship of the off r made by the united states has intimate to the undersigned that the basis proposed by the united statea cannot be accepted by spain and that even tho friendly inter vention of another power would embarasi the spanish government in proceeding with tho liberal measures it proposes to initiate to meet the requirements of the situation in the antilles lhe undersigned there fore in conformity with instructions with draws the ott.r of good offices of the presi dent of the united state 9 heretofore com municated to the government of the re gent and while both nations will reserve their full liberty of action if occasion shall hereafter arise when the united states may contribute by their friendly cooperation to the settlement of tho question at issue in cuba the undersigned is instruct to state that the president will be happy ib assist in promoting a result ao conducive tv the interest of spain and america silvela to sickles october 8 18t.9 in your note in accordance with the instruc tions of tbe united states you withdraw the . if ra of good offices to the insurgent in cuba tho spanish government had accepted with gratiiude these humanitary offices which it did not aocept becau it could not were all tbe basis upon whicli they were founded basis which evidently as it now appears constituted the essential condition of the offer the spanish gov ernm-nt could not accept the basts the t.rst of which was the independence cf cuba becauceeven if they had wished it it was not within their competence to assen to the dismemberment of the territory o this monarchy without the permission or an - thorization of cortes but the cortes waa far r r permitting and authorizing this aa manifested by the unanimous reso lution of their permanent commis sion that they were ready to lend their entire support to tho government in an elevated and dignfied poli y on the cu ban question calculated to preserve the integrity of the territory and national honor and were disposed to convok national representatives to strengthen th action of the government tho span ish government proposed spontaneously to present to the constituent courts for their deliberation in accord with the depu tits of the island measures which should tend to give to the cubans the liberties their condition may require in harmouy with th-.se proclaimed in spain—a complete amnesty for those who have fought against the mother country gradual eraancipatiou of slaves and the ri^ht of the tree toj hold pubic offices and share in making lawa humanitary and good offices were accepted with gratitude upon this basis if the united statea now withdraws then it is apparently because they consider aa indexible the basis ot any negotiations the doc.arat.on ol independence to which respect the gov ernment professes to the constitution of spain no other consideration not less im portant permit us to ac.-_._e but as the offer of good offices is being withdrawn the spanish government baa do no lesa than 2 insider the basis and conclusions on wtrch they were foundud as having passed out i.f view this is sufficient to causa the span ish government t recognize the fairness of the united states and th respect which is due to the sovereignty of a people which haa been its friend and ally from the be ginning of ita glorious history your ex cellency moreover observes in ending yoer note that while the president of the re public reserves his liberty of action he will be happy if he can contribute anything to the pacification of cuba which will result equally advantageous to the interest of america and spain his frank and aoble declaration is extremely satisfactory and i beg that your affairs the following appear among tha corres pondence from minister sickles to minister fish october 16 1863 i i have the honor to transmit herewith a copy of my note addressed to the minister of state silvela on the 28th ult., and a copy and translation of hia reply dated the sth inst sickles to si i vela septemper 2s isl.c the undersigned had the honor i a july last to offer to spain good the ofecesof the united states in a manner that should ba found most expedient for the peacificationof cnba tbe minister of state in a subsequent conference communicate to the undersigned a reply of the cabinet of madrid to th over ture and the undersigned having duly transmitted the same to his goverment in forniod the minister of state on the 3d uf september of the views of the presi dent in regard to the basis suggested on tbe part of spain in that conference and at the same time communicated to tbe cabinet of madrid the basis proposed by the united states for an adjustment of the questions pending between spain and cnba the propositions were deemed by the pres dent to be most advantageous to all inter ests compromised by the deplorable conflict in cuba and t it was believed that this arrangement would be acceptable to spain the minister of state acknowledging tbe sincerity and friendship of the off r made by the united states has intimate to the undersigned that the basis proposed by the united statea cannot be accepted by spain and that even tho friendly inter vention of another power would embarasi the spanish government in proceeding with tho liberal measures it proposes to initiate to meet the requirements of the situation in the antilles lhe undersigned there fore in conformity with instructions with draws the ott.r of good offices of the presi dent of the united state 9 heretofore com municated to the government of the re gent and while both nations will reserve their full liberty of action if occasion shall hereafter arise when the united states may contribute by their friendly cooperation to the settlement of tho question at issue in cuba the undersigned is instruct to state that the president will be happy ib assist in promoting a result ao conducive tv the interest of spain and america silvela to sickles october 8 18t.9 in your note in accordance with the instruc tions of tbe united states you withdraw the . if ra of good offices to the insurgent in cuba tho spanish government had accepted with gratiiude these humanitary offices which it did not aocept becau it could not were all tbe basis upon whicli they were founded basis which evidently as it now appears constituted the essential condition of the offer the spanish gov ernm-nt could not accept the basts the t.rst of which was the independence cf cuba becauceeven if they had wished it it was not within their competence to assen to the dismemberment of the territory o this monarchy without the permission or an - thorization of cortes but the cortes waa far r r permitting and authorizing this aa manifested by the unanimous reso lution of their permanent commis sion that they were ready to lend their entire support to tho government in an elevated and dignfied poli y on the cu ban question calculated to preserve the integrity of the territory and national honor and were disposed to convok national representatives to strengthen th action of the government tho span ish government proposed spontaneously to present to the constituent courts for their deliberation in accord with the depu tits of the island measures which should tend to give to the cubans the liberties their condition may require in harmouy with th-.se proclaimed in spain—a complete amnesty for those who have fought against the mother country gradual eraancipatiou of slaves and the ri^ht of the tree toj hold pubic offices and share in making lawa humanitary and good offices were accepted with gratitude upon this basis if the united statea now withdraws then it is apparently because they consider aa indexible the basis ot any negotiations the doc.arat.on ol independence to which respect the gov ernment professes to the constitution of spain no other consideration not less im portant permit us to ac.-_._e but as the offer of good offices is being withdrawn the spanish government baa do no lesa than 2 insider the basis and conclusions on wtrch they were foundud as having passed out i.f view this is sufficient to causa the span ish government t recognize the fairness of the united states and th respect which is due to the sovereignty of a people which haa been its friend and ally from the be ginning of ita glorious history your ex cellency moreover observes in ending yoer note that while the president of the re public reserves his liberty of action he will be happy if he can contribute anything to the pacification of cuba which will result equally advantageous to the interest of america and spain his frank and aoble declaration is extremely satisfactory and i beg that your excellency will preaent to tho president the thanks of the spanish government at the same time 1 venture to indicate two a t which it is in his power to accomplish and which will serve aa an illustration of the loyal and friendly people towards spain first to exercise hie natural in fluence upon those who having taken re fuge in american territory to foment rebel lion to the end that they
