york and a g murray at canandaigua new york draft of thk finding bill the following is a draft of the funding bill as passed this afternoon section 1 provides for the issue of two hundred million tire per cent bonds three hundred million four and a half per cent bonds and one thousand million four per cent bonds running ten fifteen and thirty years section 2 authorizes the secretary of the treasury to sell said bonds at par for coin and to apply the proceeds to the re demption of outstanding five-twenties at their par value as he may exchange new for old bonds at par for par but the new bonds shall be used for no other purpose a sum not exceeding one-half per cent for disposing of the new bonds section 3 is unimportant section 4 provides for the redemption of the five-twenties now or hereafter falling due at par beginning with those tint num x-rvl aud isitued and to cease three months after the proper notice has been given section i authorizes two and a half per cent on gold deposits twenty-five per cent of such deposits to be retained in the treas ury of the united states and the balance to be used in the redemption of 5-20's under the provisions of section 4 seetie^hi the secretary of the treasury to take tbe necessary measures to recover any moneys drawn by general howard from the united states treasury aa com missioner of the freedmen's bureau and disbursed in hi house on ths 26 the witness not having arrived iea starr asked permission to testify on hia own behalf the district attanwy objeoted and the conrt refused thsw'qtteat the defense claimed that the territory invaded waa the domion of que bec not of canada as recited in the indict ment that starr did not eriginate prepare or set on foot any expedition he did not join it until it was on the ground and the counsel held that prisoner was entitled to a strict construction of the statute and moved for his disoharg the district attorney replied that the indict ment was correct there was no proof of any actual pre parations by star bat he oflaiated as com mander of the fenian force and the prison er's actions oome within the provisions of the statutes the importance of the case grew out of the international complications involved and as a test whether nsutrality laws would be enforced where ireat britain was concerned he asked the jury to do jastioe not only so far as canada waa oonoerned but justice to themselves in order that war might not be forced upon the country hon a j parker submitted on behalf of the prisoner that the judge should charge the jury first that the words of the statute begun and set on foot do not apply to carrying on an expedition ; second these words are oot applicable to subordin ates joining an expedition after it is set ok foot third that the same do not apply to any one joining an expedition to a foreign country fourth that the prisoner is not responsible for acts done in a foreign country nor does the statute apply to such judge woodruff then delivered his charge to the jury and the latter retired to con sider their verdict judge woodruff in charging the jury alluded to the importance of the case as in volving a maintenance of the national peace and security he coincided with the pris oner's counsel that the acts done in a foreign territory were not within the juris diction of the court suoh acts however might be considered as explaining and howlog the object of an expedition organ ized in the states if the prisoner took command of and prosecuted a military ex pedition from the htawa into canada they must find him guilty he then reviewed the testimony as to starr's ar riving ou the ground and making a peech to the man and jrinnelts evidence as to its substenoe was sufficiently clear he read the statements in the buffalo papers and charged that aooordlag to these statements stair made a forward movement from trout river in order to prevent the i'nited states troops from breaking up the expedition the lifo and history of the prisoner he said exoites sympathy in the ninds of the jurors and also in his owi mind but he deeply regretted that he tionld devote his bravery and military position to give character and inspiration to so disgraceful an enterprise mr fanrot asked the court to charge that the prisoner if others set on foot the expedition unknown to him was not re sponsible jndgs woodruff did not see that the case warranted snch a charge hon a j parker said he wished it un erstood that the defence took exceptions to the points in the judge's charge which were not in aecordanoe with the points re nested to be the charge the judge noted the objections but said there was no bill of exceptions allowed in snch cases the verdict in gey htarr's case the jury brought in a verdict of guilty on two hardenburgh put in a demurrer and mr parker stated that be was not prepared to arc us the demurrer the governor stated that he would take time to consider the demurrer and then followed in a conversational way a disouision of the point raised by mr mor ris counsel in their demurrer ifr hard enburgh stated that they dented each and every charge brought against the district attorney but claimed that even if the were all proven the governor was not au thorized to proceed any further the ses sion then closed the governor saying h would examine the authorities on the point raised in the
